He focuses his practice on the defense, development, and strategic employment of his clients' intellectual property assets. He has litigated complex patent issues, negotiated licenses, and advised businesses in capitalizing on their intellectual property in the photovoltaic, alternative energy, Internet, telecommunications, semiconductor, medical devices, auto safety, electronics, media and entertainment, sports gear, pharmaceutical, and software industries. Mr. Kallus's background spans a wide range of technologies, including photovoltaics, photoresists, high energy ion beam implanters, lithography, point-of-load regulators, compact discs, flash memory, software authentication code, Internet address locators, MPEG, bone sutures, breast pumps, global positioning systems, cellular phone chip sets, athletic footwear, voice recognition software, air bags, sucralose, and kidney dialysis. He has defended the intellectual property rights of clients in federal and state courts throughout the United States, including before the International Trade Commission and the Federal Court of Claims, and has drafted complex service agreement, high value licenses, and performed due diligence for companies before purchase of intellectual property assets. Mr. Kallus speaks frequently on complex intellectual property laws and rulings. He also has spoken at conferences aiding startup companies on the protection of their inventions and the attraction of venture capital. Prior to establishing his own law practice, Michael Kallus worked for five years as an associate attorney in two of America's most prestigious intellectual property practices. There he worked on projects for international companies such as Microsoft, Google, Apple, Applied Materials, Advanced Ion Beam Technology; Fresenius, Pliva, and NXP. He also served a one-year judicial clerkship for Chief Judge C. Roger Vinson of the U.S. District Court for the Northern District of Florida, Pensacola Division. Mr. Kallus's work experience includes the following representations: Drafted motion that resulted in the dismissal, with prejudice, of an infringement case while only at the discovery stage, ensuring continued availability of a radical improvement in ion beam implantation and saving client significant distractions of trial. Argued a summary judgment motion resulting in the dismissal of the plaintiff's claims to his client's 14 lithographic printing patents. Ensured that top-quality airbags remained available as an integral part of a trial team that won a favorable settlement for a renowned auto safety device maker. Performed market and damages analysis for a proposed generic antibiotic and directly advised a top international pharmaceutical company's board of directors, resulting in a $200 million product launch. Interpreted hyper linking patent claims, limited patent scope by defining priority of the claims, and identified relevant prior inventions and publications on behalf of a renowned Internet company that invalidated an asserted patent resulting in the dismissal with prejudice of a $100 million lawsuit. Conducted patent due diligence for a major equity firm that determined the boundaries of complex telecommunications patent claims. This included the review of file histories, application of the claims to public devices/methods, and the anticipation of the invalidity and noninfringement defenses that prevented the client from purchasing a risky patent. Education Mr. Kallus earned his J.D. from the University Of Virginia School Of Law in 2003, where he was an editor for the Virginia Journal of Law and Social Policy and a participant in both the Lyle and Jessup International Moot Courts. Mr. Kallus earned his B.A. in political science from the University of California, Berkeley in 1997, where he was a member of the varsity water polo team. |
